Jamie's Tuition: Full Terms and Conditions

1. General

1.1 All Tuition is to take place remotely/online, unless agreed otherwise with the Tutor.

1.2 All Tuition is to be arranged on either an ‘Ad hoc‘ or ‘Recurring’ basis.

1.3 Recurring Tutorials are delivered at a particular regular time-slot and recur at a weekly frequency until a course of tuition is terminated (e.g. Wednesdays, 4pm, 1 hour).

1.4 Ad hoc Tutorials are delivered at particular dates and times which are arranged individually or in small blocks (e.g. 05/06/18, 10am, 1.5 hours).

1.5 Minimum length of any tutorial is one hour, unless agreed otherwise with the Tutor. Longer tutorials can be booked for 1.5 hours, 2 hours or 3 hours.

1.6 The Client is responsible for the welfare of any children or vulnerable adults at all times. Online sessions may be recorded on request of the Client.

1.7 The Client must ensure that suitable equipment is provided for tutorials (e.g. a working laptop with a sufficient internet connection).

1.8 The Client must ensure that tutorials take place in a suitable environment (e.g. a quiet room with a desk).

 

 

2. Fees

 

2.1 All tutorials will be charged at the following rates: 1 hour: £50.00, 1.5 hours: £70, 2 hours: £85, 3 hours: £110.

2.2 Any recommended materials purchased on behalf of the Client will be charged to the Client in addition to the Tuition Fees. Such purchases will be agreed in advance with the Client.

 

2.3 Unless explicitly agreed upon in advance, additional tuition services provided in addition to formally booked tutorials will not be charged to the Client, (e.g. marking homework, responding to messages/emails, provision of digital resources).

2.4 All additional expenses are the responsibility of the Tutor.

 

 

3. Payments

 

3.1 In order to reserve time-slots for Tutorials, a Security Deposit is required in advance of the first session, as per individual invoice.

 

3.2 Once a Deposit has been paid, Tutorials may be booked at any time (subject to availability).

 

3.3 Tuition Fees for all Tutorials are charged via Direct Debit on a monthly basis, after tutorials have taken place. The Client's Deposit is not an advance payment of Tuition Fees.

 

3.4 Deposits are refundable in full upon completion of a course of tuition, provided sufficient notice has been given and there are no outstanding Tuition Fees are due.

 

3.5 It is the Client’s responsibility to notify the Tutor within 14 days if they disagree with any charges.

 

3.6 If a Direct Debit is cancelled and an invoice remains unpaid for more than 14 days from the date of issue, the Tutor reserves the right to cancel any bookings and issue a Final invoice.

 

 

4. Cancellations and Continuity

 

4.1 It is the Client’s responsibility to ensure that all tutorials are able to take place as agreed with the Tutor, and that a reasonable degree of continuity is maintained for Recurring Tutorials. The Client may ‘cancel’ a tutorial at any time but may be required to pay full or partial tuition fees if insufficient notice has been given, or if a reasonable degree of continuity is not being maintained.

 

4.2 If the Client cancels any tutorial after 12pm, 2 days before the day of the tutorial or the tutorial is not attended, the Client will be charged the full Fees for the tutorial.

4.3 If the Client cancels any tutorial before 12pm, 2 days before the day of the tutorial, the Client will not be charged any Fees for the tutorial, unless other conditions apply.

4.4 If the Tutor cancels any tutorial at any time the Client will not be charged any Fees.

4.5 It is expected that Recurring Tutorials will take place with a reasonable degree of continuity until the course of tuition is terminated. In the case that the Client cancels two Recurring Tutorials in a single half-term period, any further cancellations during that period may be charged to the Client at full price, regardless of any notice given.

4.6 If a lack of continuity is sustained by the Client on a long-term basis the Tutor reserves the right to terminate the course of the tuition, subject to the relevant terms and conditions.

4.7 If a tutorial is cancelled by the Client, the Tutor may offer to rearrange the session for an alternative time within 7 days of the cancelled tutorial at no additional charge. 

4.8 Recurring tutorials do not take place during school holidays. Tutorials during school holidays can only be booked on an Ad hoc basis (subject to availability). It is the Client's responsibility to request extra tuition during school holidays if required.

5. Termination, Adjournment and Alterations

5.1 Recurring Tutorials continue on a regular basis until an agreed termination date. If no date has been agreed, the course of tuition will continue indefinitely until a termination date is set. Recurring Tutorials may be altered to a different regular time-slot or temporarily adjourned without terminating the course of tuition or cancelling any tutorials.

5.2 If a Client is no longer able to meet the agreed regular time-slot of a Recurring Tutorial the Client may request a new time-slot. Any alterations to the regular time-slot for a Recurring tutorial must be agreed with the Tutor and are subject to availability. A notice period of one calendar month is required in the case that no alternative time-slot is immediately available and the Client is required to terminate their Regular Tutorial.

5.3 If a Client wishes to adjourn a course of Recurring tuition the Client must agree the exact period of adjournment with the Tutor in advance. Adjournment of a course of Recurring tuition must be agreed with the Tutor and may not always be possible. Any Recurring Tutorials cancelled by the Client after a period of adjournment are subject to the normal Terms and Conditions.

5.4 If the Client wishes to terminate a course of Recurring tuition before the agreed date or when no date has been agreed, a minimum of one calendar month’s notice must be given by the Client. If less than one calendar month’s notice of termination is given by the Client or if any tutorials are cancelled by the Client during this period of notice, Tuition Fees for all Recurring Tutorials may be charged to the Client in full for one calendar month after the date of notice.

6. Limitation of Liability

6.1 While the Tutor will endeavour to ensure satisfactory progress is made, this cannot be guaranteed and the Tutor cannot be held accountable for any academic success or otherwise.

6.2 Additional materials or assignments recommended by the Tutor will not be essential to the tuition, but may be deemed necessary by the Tutor for efficient progress. Failure by the Client to follow any recommendations made by the Tutor may hinder the progress of the tuition.

6.3 To the maximum extent permitted by law, the Tutor accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Tutor’s services or any errors or omissions in the content of the Tutor’s learning materials.

6.4 It will be noted that the Tutor holds an Enhanced DBS disclosure, evidence of which can be provided upon request.
